Terms and Conditions

Welcome to BikeRepairLasCruces.com, operated by The Bicycle Studio, LLC ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, services, and any related offerings (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By using our Services, you affirm that you are at least 18 years old or have the legal capacity to enter into a binding agreement. You agree to comply with all applicable laws and regulations in connection with your use of our Services.

2. Description of Services

BikeRepairLasCruces.com provides bicycle repair and maintenance services. Our Services may include, but are not limited to, diagnostics, part replacement, adjustments, and general repair and upkeep of bicycles. We reserve the right to modify or discontinue any part of our Services at any time without prior notice.

3. Scheduling and Appointments

Appointment Requests: All service is done by appointment only and all appointments are subject to availability. You may request an appointment through our website, by phone, or in person.
Confirmation: Your appointment is not confirmed until you receive a confirmation from us.
Cancellations and Rescheduling: We request that you provide us with reasonable notice if you need to cancel or reschedule an appointment.

4. Pricing and Payment

Estimates and Rates: All services start at $80 an hour. We will provide an estimate for services and parts before commencing work. This estimate is an approximation and may be subject to change if unforeseen issues arise or if additional parts or labor are required. We will endeavor to communicate any significant changes to you promptly.
Payment Due: Payment for all services and parts is due in full upon completion of the repair and before the bicycle is picked up.
Accepted Payment Methods: We accept cash, major credit cards, debit cards through PayPal.
Unclaimed Bicycles: Bicycles left for repair that are not picked up within 30 days after notification of completion, and without prior arrangement, may be subject to storage fees or, after 60 days may be considered abandoned and disposed of or sold to recover repair and storage costs, as permitted by New Mexico law. We will make reasonable efforts to contact you before taking such action. It is your responsibility to pick up your bike once repaired.

5. Release of Liability and Indemnification

READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY AND MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS.

By submitting your bicycle for repair or using any of our Services, you acknowledge and agree to the following:

A. LIMITATION OF LIABILITY FOR REPAIRS: The Bicycle Studio, LLC, doing business as BikeRepairLasCruces.com, its owners, employees, agents, and affiliates (collectively, "The Bicycle Studio Parties"), shall not be liable for any personal injury, property damage, or any other loss, damage, or expense, direct or indirect, special, incidental, consequential, or punitive, arising from or in any way related to any bicycle repair or maintenance services provided by The Bicycle Studio Parties. This limitation of liability applies to, but is not limited to, damages caused by faulty repairs, improper assembly, defective parts, or any other aspect of the services provided, even if such damages result from the negligence of The Bicycle Studio Parties. Your sole and exclusive remedy for any dissatisfaction with our services is the re-performance of the specific repair, or, at our discretion, a refund for the cost of the repair.

B. USE AT YOUR OWN RISK: You understand and acknowledge that cycling involves inherent risks, including but not limited to, falls, collisions, and other accidents that may result in serious injury, disability, or death. You voluntarily assume all risks associated with the use of your bicycle after it has been repaired or serviced by The Bicycle Studio Parties. You agree that your use of the repaired bicycle is entirely at your own risk.

C. INDEMNIFICATION: You agree to indemnify, defend, and hold harmless The Bicycle Studio Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your use of the bicycle after it has been repaired or serviced by us.
Any breach by you of these Terms and Conditions.
Your negligence or willful misconduct.

D. WAIVER OF CLAIMS: To the fullest extent permitted by New Mexico law, you hereby waive any and all claims, demands, actions, or causes of action, known or unknown, foreseen or unforeseen, that you may have against The Bicycle Studio Parties related to the repair or maintenance services provided, or the subsequent use of your bicycle.

6. Warranty on Repairs and Parts

Workmanship: We warrant our repair workmanship for a period of 30 days from the date of pickup, provided the bicycle has not been tampered with or subjected to unusual stress or misuse. This warranty covers the specific work performed and does not cover subsequent damage unrelated to our repair.
Parts: New parts installed by us may carry a manufacturer's warranty. We will assist you in making a warranty claim with the manufacturer, but we do not provide additional warranties on parts beyond the manufacturer's warranty.
Exclusions: This warranty does not cover normal wear and tear, abuse, neglect, accidents, or damage caused by improper use or maintenance after the bicycle leaves our shop.

7. Intellectual Property

All content on BikeRepairLasCruces.com, including text, graphics, logos, images, and software, is the property of The Bicycle Studio, LLC or its licensors and is protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any content without our express written permission.

8. User Conduct

You agree not to use our Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our website or interfere with any other party's use and enjoyment of our Services.

9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or our Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Doña Ana County, New Mexico.

10. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

11. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and The Bicycle Studio, LLC regarding your use of our Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. The "Effective Date" at the top of this page will indicate when the Terms were last revised. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.
